ZBA OKs Wildcat Way property division

The Zoning Board of Adjustments (ZBA) approved a subdivision plat, among other items of business at their Tuesday meeting.

The board then reviewed a plat request in the 5000 block of County Road 1100 and State Highway 19/Wildcat Way of 19 total acres. Owners Debra and Kallie Tanton were requesting to subdivide into parcels of approximately 17.78 and 1.22 acres, respectively, according to Community Development Director Tory Niewiadomski.

Although served by Shady Grove Water Supply, the piece of land falls within city limits, Niewiadomski said.

The city sent out letters to property owners within 200 feet of the property, and besides Debra and Kallie, did not receive any replies. Debra and Kallie replied they were in favor of subdividing the land.

“I only had to ask one question to make my determination,” said ZBA member Jay Julian. “I asked the applicant if they owned the land prior to the Wildcat Way annexation in the mid-2000s.”

The Tantons indicated yes, they had owned the property prior to 2006. Julian indicated he believed this is consistent with prior precedent regarding zoning board law, wherein the “hardship” the property owner now faces is not “self-created.”

“Through no fault of the property owner, the land is now restricted in a manner generally considered forbidden by the now applicable zoning ordinance as a result of the annexation,” Julian told the News-Telegram. “If it were not for the annexation...that subjects the land to the city’s zoning ordinances, there would be no problem.”

After additional discussion, the board unanimously approved the plat request.

The board also unanimously approved an application for a permanent makeup license for Salon Laveau, 312 Davis St., upon the prior recommendation of the Planning and Zoning Commission (P&Z) the previous evening.

With no additional business, the meeting was adjourned.
