Embro nabs local, out-of-state reported users

Body

Two different pairs were arrested this weekend in Cumby for charges of possession of a controlled substance, among other charges, according to police reports.

At approximately 3:01 a.m. on Saturday, June 15, Cumby police Sergeant Ray Embro was on routine patrol when he stated that he observed a beige Trailblazer pull into the I-30 Fast Mart gas station parking lot located at approximately 107C East Service Road I-30 North.

Due to the early hour, the gas station was not open at the time, reports state. The sargeant repeated a lap of the block, the report said, and still saw the Trailblazer in the lot. Concerned about “recent attempted burglaries on the neighboring businesses,” Embro conducted a traffic stop, “to ensure no criminal activity was taking place,” the report said.

The driver and passenger of the vehicle, Wesley Robert Rose, 36, of Talco, and Billy Clay Kirby, 49, of Cumby, stated they “stopped to grab some ice from the ice machine,” according to the report.

However, the report said, Embro found the pair to be nervous and “their travel plans did not make sense.”

Embro gained consent to search the vehicle, according to the report, where he reportedly located a plastic baggy containing the residue of a white crystal-like substance believed to be methamphetamine. The report states that Embro allegedly located a red plastic straw as well as a marijuana cigarette.

Rose, the vehicle’s driver, allegedly advised Sergeant Embro “as they were being pulled over, [Kirby] illegal contraband believed to be methamphetamine, and also threw illegal contraband out the front passenger window.”

Embro alleged in his report that while talking to Kirby, he located on his shirt a “large white crystal-like substance believed to be methamphetamine.”

Rose was booked in to HCSO for one charge of possession of a controlled substance of less than one gram. Kirby was booked in for one charge of possession of a controlled substance of less than one gram, as well as a charge of tampering with or fabricating physical evidence.

Less than twenty four hours later, Embro was back on patrol when he pulled over another duo for allegedly possessing controlled substances.

At approximately 1:28 a.m. on Sunday, June 16, Embro reported that he observed a vehicle on I-30 westbound at approximately mile marker 109 that had no license plate light. At that point he initiated a traffic stop, the report said.

Driver Joshua Devin DePriest, 28, of Russellville, Arkansas, and passenger Alexis Danielle Carlson, 23, of Little Rock Arkansas, were allegedly nervous and “not truthful with their answers to questions,” according to the report.

Carlson allegedly advised that there was a marijuana pipe in the vehicle, so Embro performed a probable cause search, the report says.

At that time, according to the report, DePriest informed Embro that there was a methamphetamine pipe and possibly methamphetamine in the center console of the vehicle, and that DePriest allegedly “had used methamphetamine earlier in the evening.”

The report says that deputies located a clear glass pipe containing traces of a substance believed to be methamphetamine, as well as a marijuana pipe and “two bottles containing unidentified pills.”

Both DePriest and Carlson were booked in to HCSO under one charge each of possession of a controlled substance between one and four grams.

After their arrests, HCSO Deputy Lester arrived and took a small brown dog in their possession to the Sulphur Springs Animal Shelter.
